Civil compensation claims

In Scotland, as soon as a person is identified as having an asbestos disease that they believe is related to exposure to asbestos during their employment, or anywhere else, they have three years from this date to make an asbestos related claim.

Any employer or organisation which negligently uncovered anyone to asbestos and written for a sufferer's asbestos related disease may be held accountable and their insurers may be legally in charge of paying reimbursement.

This is still true if the company is no longer around, as long as the attorney can identify who the employer's liability insurers were.

Pleural plaques claims

According to Scottish Rules, if the sufferer will not claim within this 3-year period, they might be time-barred from bringing a pleural plaques claim forward - or any claim for just about any other asbestos related conditions that develop, even if they happen to be more serious.

Mesothelioma claims

Around two hundred people in Scotland are identified as having mesothelioma every 12 months, an asbestos-related cancer that is caused by publicity to asbestos dust.

Just like asbestosis, it can be several years (up to 45 years in a few cases) between a person being subjected to asbestos and their symptoms developing.

We understand that making a mesothelioma cancer compensation claim could be the previous thing on your head. However, if you are exposed to asbestos and developed mesothelioma as a result, you have entitlement to compensation in Ireland.
